Early in its history, portions of the 243 parcels in Haven View Estates were owned by three individual investors who decided to create separate homeowner’s associations (HOAs) that could elect their own board members and be governed by their own covenants, codes and restrictions (CC&Rs). Today, these entities exist as Haven View Estates (HVE), consisting of 53 custom homes and lots, RCV at Haven View Estates (RCV), consisting of 150 custom and semi-custom homes and lots and The Heights at Haven View Estates (THH), consisting of 40 semi-custom homes, as shown in the community map below.
Each of these HOAs has the individual right to vote on issues that affect residents, properties and thoroughfares within its part of the Haven View Estates community. Each also has a one vote per lot voice in affairs that affect the entire community.
When the proposed construction of a staffed gatehouse and preliminary budget was presented to each of the three HOAs, the Heights’ board (THH) immediately indicated that it might not participate. So, both HVE and RCV decided to proceed without that participation.
Shortly after construction began, a second proposal was put forth to equip the gatehouse and entry and exit areas with advanced electronics to support visitor management. Again, THHs’ board abstained and, again, both HVE and RCV decided to proceed.
Once the project was completed, and the benefits were clear, HVE and RCV presented the Heights board with a special long-term financing proposal that would allow the full participation of THH residents at a very low cost. However, this too was rejected. As a result, neither the residents of the Heights nor their guests currently enjoy gatehouse amenities, and gatehouse staff may not provide either with services of any kind. Furthermore, Heights residents are restricted to non-member entrances and must reply on the community call directory to communicate with and receive awaiting visitors. This effectively makes THH a gated community only – not the staffed gatehouse community that it might outwardly appear to be.
Parties interested in property within the Heights (THH) HOA, as outlined in the grey area of the map above, should be aware of this distinction in both gatehouse status and available amenities.
